The actual privacy policy of personal data (hereinafter – Privacy Policy) applies to all information, which fcenerge.pl, located at fcenerge.pl, may receive about the Consumer while using the site, programs and products.

1.1.1.”Administration of the site fcenerge.pl (hereinafter – Site Administration) – employees authorized to manage the site, acting on behalf of fcenerge.pl, who organize and carry out the processing of personal data, as well as determine the purposes of personal data processing, the composition of personal data to be processed , actions or operations performed with personal data.

1.1.2. “Personal data” is any information relating directly or indirectly to an individual (the subject of the personal data).

1.1.4. “Confidentiality of personal data” is a mandatory for compliance by the Administrator or another person who has gained access to the personal data to prevent its dissemination without the consent of the personal data subject or the existence of another legal basis.

1.1.5. The user of the fcenerge.pl website is a person who has access to the Site via the Internet and uses the Site.

1.1.6. “Cookies” are a small piece of data sent by the web server, which is stored on the user’s computer and which the web client or web browser sends to the web server in an HTTP (HyperText Transfer Protocol)request every time when trying to open the page of the corresponding site.

1.1.7. “IP address” is a unique network address of a node in a computer network built according to the IP protocol.

2. GENERAL PROVISIONS

2.1. The User’s use of the fcenerge.pl site means consent to this Privacy Policy and the terms of processing the User’s personal data.

2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the site.

This Privacy Policy establishes the obligations of the Site Administration regarding non-disclosure and ensuring the privacy protection regime of personal data, which the User must provide to the Site Administration upon request when placing an order for the purchase of the Product or leaving an application for a callback.

3.3.2.  Ifcenerge.pl collects statistics about the IP addresses of its visitors.  This information is used for the purpose of identifying and solving technical problems, to control the legality of financial payments made. 

3.4. Any other personal information not stipulated above (purchase history, used browsers and operating systems, etc.) is subject to reliable storage and non-distribution, except for the cases provided for in paragraph  5.2.  and 5.3.  of this Privacy Policy. 

4. PURPOSES OF COLLECTION OF USER’S PERSONAL INFORMATION. 

4.1.  The administration of the fcenerge.pl site can use the User’s personal data for the following purposes:

4.1.1.  Identification of the User for placing an order and (or) concluding a contract of purchase and sale of goods remotely from fcenerge.pl.

4.1.3.  Establishing feedback with the User, including the direction of messages, requests related to the use of the fcenerge.pl site, provision of services, processing of requests and applications from the User.  4.1.4.  Determining the location of the user to ensure security and prevent fraud.

5. METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING

 5.1.  The processing of the User’s personal data is carried out without limitation of terms, in any legal way, including in information systems of personal data with the use of automation means or without the use of such means.

5.2.  The User agrees that the Administration of the fcenerge.pl site has the right to transfer personal data to third parties, in particular, courier services, postal organizations, telecommunications operators, solely for the purpose of fulfilling the User’s order placed on the fcenerge.pl Site  , including delivery of goods. 

5.3.  The User’s personal data may be transferred to the authorized bodies of the state authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.

5.4.  In case of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data

5.5.  The site administration takes necessary and sufficient organizational and technical measures to protect personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions with it by third parties.

5.6.  The site administration, together with the User, takes all necessary measures to prevent damage or other negative consequences caused by the loss or disclosure of personal  data of User.

6. OBLIGATIONS OF THE PARTIES. 

6.1.  The user is obliged to:

 6.1.1.  Provide information about personal data necessary for using the fcenerge.pl Site.

 6.1.2.  Update and supplement the provided information about personal data in case of changes to this information.

6.2.  The site administration is obliged to:

6.2.1.  Use the received information exclusively for the purposes specified in paragraph 4 of this Privacy Policy. 

6.2.2.  To ensure that confidential information is kept confidential, not to be disclosed without the prior written consent of the User, as well as not to sell, exchange, publish, or disclose in other possible ways the transferred personal data of the User, with the exception of paragraphs 5.2.  and 5.3.  of this Privacy Policy.

6.2.3.  Take precautions to protect the confidentiality of the User’s personal data in accordance with the procedure that is usually used to protect this kind of information in the current business.

 6.2.4.  To block personal data related to the relevant User from the moment of application or request by the User, his legal representative or the authorized body for the protection of the rights of the subjects of personal data for the period of verification, in case of detection of false personal data or illegal actions.

7. LIABILITY OF THE PARTIES. 

7.1.  The administration of the site, which has not fulfilled its obligations, is responsible for the losses incurred by the User in connection with the improper use of personal data, in accordance with the legislation of Ukraine, with the exception of the cases provided for in paragraphs  5.2.  , 5.3.  and 7.2.  of this Privacy Policy. 

7.2.  In case of loss or disclosure of Confidential Information, the Site Administration is not responsible if the given confidential information:

7.2.1.  Became public property before its loss or disclosure.

7.2.2.  It was received from a third party before it was received by the Site Administration.

7.2.3.  It was disclosed with the User’s consent.

  8. RESOLUTION OF DISPUTES.

 8.1.  Before filing a claim in court in disputes arising from the relationship between the User of the fcenerge.pl site and the Site Administration, it is mandatory to present a claim (a written proposal for voluntary settlement of the dispute). 

8.3.  If an agreement is not reached, the dispute will be referred to a judicial body for consideration in accordance with the current legislation of Ukraine. 

8.4.  The current legislation of Ukraine applies to this privacy policy and the relationship between the User and the Site Administration.

 9. ADDITIONAL TERMS.

 9.1.  The site administration has the right to make changes to this Privacy Policy without the User’s consent.

9.2.  The new Privacy Policy enters into force from the moment of its posting on the Site, unless otherwise provided by the new version of the Privacy Policy.
